About Jobric’s Privacy Program

Jobric is the Controller of your personal data.

We are committed to safeguarding the privacy and personal data of our website visitors, clients, partners, associates and others. Our privacy program is governed, in part, by the EU’s General Data Protection Regulation (GDPR), the Data Protection Act of 2018 and other laws and regulations. We recognize other jurisdictions’ decisions and interpretations of the GDPR, and our program reflects those requirements when we operate in those areas, including serving clients there. This Privacy Policy outlines how we collect, manage, use and protect your personal data.

Personal data that we process means any information that relates to a living, identifiable person, including but not limited to names, physical and email addresses, internet identifiers, phone numbers, and other information relating to that person, and either individually or combined that can be used to identify that person.

Usage Data

We may process data about your use of our website, apps and services. The usage data may include:

website navigation paths;
information you provide to use the Services (such as your Resume or CV); or
information about the timing, frequency and pattern of your service use.

The source of the anonymized usage data is our website or services. We process this information for service performance monitoring and security purposes, and to improve our website and services. Our lawful basis for processing is legitimate interests.

Account and Profile Data

When you provide personal data, such as details to purchase a service, sign up for a free or trial service, or apply to open jobs or inquire about investment in our company, we may process personal data:

email address;
payment details;
social media account ID;
electronic communications ID;
employment or candidate information; or
prospective investor self-certification information.

Special Category Data

We will not request personal data designated as special category data under the GDPR, relating to your:

Health Data: Medical records, physical/mental health information;
Biometric Data: Fingerprints or facial recognition data used to identify a person;
Religious/Philosophical Beliefs: Data revealing a person’s faith or ethical views;
Political Opinions: Information about affiliations or views;
Racial/Ethnic Origin: Information about a person’s background;
Trade Union Membership: Data regarding employment union affiliation;
Genetic Data: Inherited or acquired genetic characteristics; or
Sex Life/Sexual Orientation: Information about sexual behavior or preferences.

For the avoidance of doubt, we will not request any Special Category Data.

Children’s Data

We do not actively collect or process information from or about children (under 16). Our services and products are not knowingly directed at, nor do we knowingly collect any information from people under the age of eighteen (18). If you are under 18 years old, please do not use this website or its applications. If you learn that your child has provided us with personal data without your consent, please contact us at privacy@jobric.ai.

How We Use Artificial Intelligence

We may use technologies, including Artificial Intelligence (“AI”) to support and improve our products, services and internal operations.

In particular, we may use AI tools to:

improve operational efficiency, including automation and optimization of internal processes;
enhance product and service development, including analyzing trends and improving customer experience;
improve the quality of our services and ensure compliance with applicable standards.

We process personal data used in AI systems in line with the original purposes for which the data was collected. Where we intend to process personal data for new or different purposes, we will inform you and ensure that an appropriate legal basis is in place.

Where we use AI, we do so in a controlled and proportionate manner and in accordance with applicable data protection laws. This includes:

applying data minimization principles, including the use of anonymization or pseudonymization where appropriate;
implementing governance and oversight measures, including human review and oversight where required;
ensuring that any use of AI does not lead to unfair or discriminatory outcomes.

Where AI is used in a way that produces legal or similarly significant effects on individuals, we will ensure that appropriate safeguards are in place, including the possibility of human intervention, in line with applicable legal requirements.

Automated Decision Making

We may use automated decision-making processes to make decisions about you, including profiling to provide you services effectively. These automated processes may be used to implement targeted marketing initiatives. When we make an automated decision using personal data that has a legal or substantially similar effect, you have certain rights regarding that decision. Specifically, you have the right to receive meaningful information about the logic involved in the decision, the right to human intervention, the right to obtain an explanation of the decision made and to challenge it. How We Share Your Personal Data

We will not sell your personal data to any third parties, but we may sometimes share details with trusted contracted service providers who are authorized to process on our behalf, or whom we work with in partnership to deliver our services.
We may also use companies to deliver services and process your data on our behalf, including the delivery of postal mail, sending emails and text messages, processing payment or bank details and analyzing stakeholder trends anonymously to assist us in offering better services.
We may disclose your personal data to contracted third-party data processors, acting on our instruction under contract and under the same purposes, and on the lawful basis set out in this Privacy Policy.
Financial transactions relating to our services are handled by our payment services providers. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, if any, and dealing with complaints and queries relating to such transactions and protecting us from fraudulent transactions.
We do not participate in programs offered by, nor disclose personal data to, third-party suppliers of goods and services for the purpose of enabling them to contact you so that they can offer, market and sell to you relevant goods and/or services. If we enter such programs, we will update this policy and not include you unless you provide consent to opt into marketing and communications from those third parties. We may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person (for example to government bodies for tax purposes or law enforcement agencies for the prevention and detection of crime, subject to such bodies providing us with a relevant and lawful request in writing). We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

Data Sharing and Third Parties

Jobric is a Delaware registered company operating and processing data in the USA and other countries, with third-party processors noted below. We receive personal data from website visitors, app and services users from clients around the world. Also, Jobric is registered as doing business in the United Kingdom but does not have a separate legal entity there.
Jobric works with trusted, contracted third-party suppliers, contractors and partners who are authorized to process personal data:

We may transfer your personal data to other countries. The countries in the European Economic Area are considered to provide the same level of protection to personal data as the UK does. Where we transfer personal data or share it with others outside the European Economic Area, we ensure that we and those persons or companies who we transfer it to agree to protect it from improper use or disclosure, in accordance with data protection law by model clauses or other appropriate mechanisms. Companies outside the European Economic Area with whom we may share your personal data include IT providers and other suppliers necessary for the performance of the services.

Retaining, Updating and Deleting Your Personal Data

We keep personal data that you provide when using the services in order to provide the services and securely archive the information if you decide to stop using the services. Financial data is retained for up to seven years to satisfy financial reporting obligations. Cookie data are retained for the duration noted below in the cookies section. Employee and contractor personal data are retained for as long as a person is employed or contracted with us, and then retained for a period thereafter consistent with local employment regulations. User Data including Resume/CV and user related personal data provided to use the Services is kept for as long as your account is active and retained for up to a year after you close your account. Any data that is derived from the User Data including any data used to train or tune ML and AI models is anonymized.
In some cases, it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the maximum period of retention based on our legitimate needs to retain data.
Additionally, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or to protect your vital interests or the vital interests of another natural person.
Where possible, we may keep your records up to date using publicly available, professionally accessible or by-invitation sources. For example, we use LinkedIn, Facebook and other social networks’ tools as well as personal-invite features. Also, we process changes to your details when you provide them to us. We do not mass-harvest information (also known as scraping) from those sources. You may object to us keeping records up to date using these methods.
We delete your personal data at the end of the retention period, or earlier if we can. For example, if you request data be deleted and removal from marketing, we will do so before our stated retention period; but if you request service profile data to be removed before the end of our legal obligation to you, other parties or agencies, we may not be able to do so. We will notify you of these conditions.

Your Rights

Your principal rights under the GDPR are the:
- right to access.
- right to rectification.
- right to erasure.
- right to restrict processing.
- right to object to processing.
- right to data portability; and
- right to complain to a supervisory authority.
You have the right to confirm whether we process your personal data and access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your personal data. The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee.
You have the right to have any inaccurate personal data about you rectified and, considering the purposes of the processing, to have any incomplete personal data about you completed.
In some circumstances you have the right to erasure your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for exercising the right of freedom of expression and information; for compliance with a legal obligation; or for the establishment, exercise or defense of legal claims.
In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful, but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defense of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defense of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.

You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest. Currently, we do not process personal data for scientific or historical research purposes.
To the extent that the lawful basis for our processing of your personal data is:

- that the processing is necessary for the performance of a contract to which you are party or to take steps at your request prior to entering into a contract;
and such processing is carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.
If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.
To the extent that the lawful basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.
We may withhold personal information that you request to the extent permitted by law.
We may withhold personal information that you request if the requests are deemed vexatious, manifestly unfounded, excessive or repetitive.
You may instruct us at any time not to process your personal information for marketing purposes.

Glossary

Automated Decision Making is a decision based solely on automated processing if there is no meaningful human involvement in the taking of the decision.
Controller is the person or organisation which decides the purposes and means of the processing of personal data either on its own or with others.
Model clauses are standard contractual clauses which have been approved by the European Commission as providing adequate safeguards to enable personal data to be transferred outside the European Economic Area.
Personal data is any personal information relating to an individual who can be identified, directly or indirectly, by reference to that information.
Processing means any operation or set of operations which is performed on personal data such as collection, recording, organisation, structuring, storage, alteration, retrieval, consultation, use, disclosure, erasure or destruction.
Profilingmeans any form of automated processing of personal data where personal data is used to analyse or predict certain personal aspects e.g. an individual’s economic situation, health, personal preferences, interests, reliability or behaviour.
